Guardianships

A guardianship is when an adult who is not the parent is given legal custody of a minor child.  The probate court has a number of rules that must be complied with in order to get the proper orders.   It is necessary to understand the difference between guardianship of the person, and guardianship of the estate.  If a guardianship of the estate is needed, there will be accountings.  It is not unusual for these financial issues to cause some conflict in the family.

It is not uncommon for there to be issues regarding the parents visitation with the minor subject to the guardianship.  This can feel much like a custody and visitation dispute between the parents in a divorce.   Many of the same issues are involved.
